В статье проведен сравнительный анализ правового регулирования инфраструктуры обмена криптовалют в Российской Федерации, Республике Беларусь и Республике Казахстан. Рассмотрены особенности формирования нормативной базы в каждой из стран. Выделены два подхода: белорусский, основанный на создании специализированных институтов в рамках Парка высоких технологий с детальной регламентацией их деятельности, и казахстанский, ориентированный на лицензирование уже действующих криптобирж, где ключевую роль играет Международный финансовый центр «Астана» и Национальный банк Республики Казахстан. Показано, что российское законодательство пока не закрепило легальную инфраструктуру обмена криптовалют, обсуждаются лишь экспериментальные правовые режимы. Обоснована целесообразность комбинированного сценария для России, сочетающего быстрое внедрение лицензирования действующих бирж с параллельным развитием собственных регулируемых операторов.

On the Issue of Legal Regulation of Cryptocurrency Exchange Infrastructure in the Russian Federation, the Republic of Belarus and the Republic of Kazakhstan

This article presents a comparative legal analysis of the regulatory frameworks governing cryptocurrency exchange infrastructure in the Russian Federation, the Republic of Belarus, and the Republic of Kazakhstan. It examines the specificities of the formation of the normative base in each jurisdiction. Two principal regulatory approaches are distinguished: the Belarusian model, which is predicated upon the establishment of specialised institutions within the Hi-Tech Park, entailing detailed regulation of their operational activities; and the Kazakh model, which is centred on the licensing of already operational crypto exchanges, wherein the Astana International Financial Centre and the National Bank of the Republic of Kazakhstan assume a pivotal role. The analysis demonstrates that Russian legislation has yet to establish a legal infrastructure for cryptocurrency exchange, with only experimental legal regimes currently being discussed. The study substantiates the viability of a combined scenario for Russia, which would integrate the accelerated implementation of licensing for existing exchanges alongside the concomitant development of domestically regulated operators.
