В статье проводится сравнительный правовой анализ института задержания по уголовно-процессуальному законодательству Российской Федерации и уголовно-процессуальному законодательству государств Юго-Восточной Азии (Таиланд, Вьетнам). Исследованы ключевые элементы регламентации: основания, сроки, круг уполномоченных субъектов и процедурные гарантии. Выявлены особенности задержания в трёх юрисдикциях. Проведен сравнительный анализ того, как национальные правовые системы по-разному конструируют данный институт уголовно-процессуального права, отражая собственные правовые традиции и подходы к защите прав личности. Установлено, что российская модель характеризуется максимальной императивностью и судебным контролем, тогда как таиландское законодательство демонстрирует гибкость в установлении сроков в зависимости от тяжести преступления. Вьетнамская система отличается широким кругом субъектов задержания, включая граждан при задержании разыскиваемых лиц, и особыми требованиями к засвидетельствованию процедуры представителями власти и независимыми лицами. Автор обосновывает целесообразность учёта зарубежного опыта для совершенствования отечественного законодательства.

Detention of a Suspect: Comparative Legal Analysis of the Legislation of Russian Federation and Southeast Asia

The article presents a comparative legal analysis of the institution of detention under the criminal procedure legislation of the Russian Federation and the criminal procedure legislation of the states of Southeast Asia (Thailand and Vietnam). The study examines the key elements of regulation, including legal grounds, time limits, the range of competent authorities and procedural safeguards. The specific features of detention in the three jurisdictions are identified. A comparative assessment is provided of how national legal systems construct this institution of criminal procedure law in different ways, reflecting their respective legal traditions and approaches to the protection of individual rights. It is established that the Russian model is characterized by a high degree of mandatory regulation and judicial control, whereas Thai legislation demonstrates greater flexibility in setting time limits depending on the seriousness of the offence. The Vietnamese system is distinguished by a broader range of actors empowered to carry out detention, including private individuals in the apprehension of wanted persons, as well as special requirements for certification of the procedure by public officials and independent witnesses. The author argues that it is advisable to take foreign experience into account in order to improve domestic legislation.
