В статье исследуются конституционная модель разграничения предметов ведения между Российской Федерацией и ее субъектами, а также практические аспекты ее реализации в условиях современного этапа развития федеративных отношений. Автор анализирует трехзвенную конструкцию российского федерализма, закрепленную в статьях 71—73 Конституции РФ, выявляет ее теоретический потенциал и те деформации, которым она подвергается в процессе законодательной конкретизации и правоприменения. Особое внимание уделяется сфере совместного ведения как наиболее проблемной зоне, где наблюдается устойчивая тенденция к вытеснению регионального правотворчества избыточно детальным федеральным регулированием. На основе анализа законодательных новелл, судебной практики и статистических данных формулируются выводы о дисбалансах действующей модели и предлагаются возможные направления их устранения.

The Constitutional Model of Delimitation of Jurisdiction in the Russian Federation and its Practical Implementation

This article examines the constitutional model for delineating jurisdiction between the Russian Federation and its constituent entities, as well as the practical aspects of its implementation in the current stage of federal relations' development. The author analyzes the three-tiered structure enshrined in Articles 71–73 of the Russian Constitution, identifying its theoretical potential and the distortions it is subject to in the process of legislative specification and law enforcement. Particular attention is paid to the area of shared jurisdiction as the most problematic, where there is a persistent tendency for regional lawmaking to be supplanted by excessively detailed federal regulation. Based on an analysis of legislative innovations, judicial practice, and statistical data, conclusions are drawn regarding the imbalances in the current model and possible ways to address them are proposed. This article is intended for researchers of constitutional law, public administration specialists, and practicing lawyers.
