Цель данного исследования — выявление действительного соотношения федерального и регионального уровней судебной власти в Российской Федерации. Методологическую основу составили формально-юридический, сравнительно-правовой и системный анализ. В ходе работы установлено, что разграничение носит организационно-территориальный, а не функциональный характер: мировые судьи являются низовым звеном федеральной судебной системы, конституционные (уставные) суды созданы менее чем в трети регионов и факультативны. Автор делает вывод об отсутствии в Российской Федерации полноценного регионального уровня судебной власти при формальном его признании. Предложено перевести мировых судей на полное федеральное финансирование либо отказаться от категории «суды субъектов Федерации». В подтверждение этого вывода в статье проанализированы порядок назначения, финансирования и процессуальной подчиненности мировых судей, а также практика деятельности конституционных (уставных) судов в разных регионах. По мнению автора, действующая модель создает риски зависимости низового звена правосудия от региональных властей при формальной самостоятельности. Предлагаемые изменения направлены на устранение этого противоречия без разрушения единства судебной системы.

The Division of Judicial Power Between the Federal and Regional Levels in the Russian Federation

The purpose of this article is to identify the actual balance between the federal and regional levels of judicial authority in the Russian Federation. The methodological basis is formed by formal legal, comparative legal, and systemic analysis. The study established that the distinction is organizational and territorial, rather than functional: justices of the peace are the lowest level of the federal judicial system, while constitutional (charter) courts have been established in less than a third of the regions and are optional. In this article, the author concludes that a full-fledged regional level of judicial authority, even if formally recognized, does not exist in the Russian Federation. It is proposed that justices of the peace be fully funded by the federal government or that the category of «courts of constituent entities of the Federation» be abandoned. To support this conclusion, the article analyzes the procedures for the appointment, funding, and procedural subordination of justices of the peace, as well as the practices of constitutional (charter) courts in various regions. The author concludes that the current model creates the risk of dependence of the lower level of justice on regional authorities, despite formal independence. The proposed changes are aimed at eliminating this contradiction without disrupting the unity of the judicial system.
