Статья посвящена важнейшим проблемам оптимизации конституционно-правовых механизмов российского федерализма. Актуальность исследования обусловлена изменениями Основного закона, затронувшими фундаментальные принципы организации публичной власти, поставившими вопрос о пересмотре подходов к регулированию федеративных отношений. Особую остроту приобретают проблемы, связанные с современной практикой реализации федеративных принципов, которые обнаруживают заметные расхождения с конституционными установлениями. Проблемы разграничения полномочий, дисбаланс межбюджетных отношений, недостаточность учета региональной специфики — все это обусловлено актуальностью темы исследования. Рассмотрение позиций ведущих правоведов и экономистов, таких как И.В. Данилова, Е.В. Белоусова, С.С. Зенин, И.В. Иванов, А.А. Остовская, И.Н. Кузнецов, Е.Г. Тронина, Т.А. Панарина и других позволяет составить комплексную картину вызовов и возможностей оптимизации данного вопроса. Целесообразность разработки темы обусловлена особой остротой системных противоречий в разграничении предметов ведения между федеральным центром и субъектами Федерации, т. е. влиянием конституционной реформы 2020 года на баланс в федеративных отношениях. Обращено внимание на проблемы реализации принципов единства и субсидиарности в условиях централизации управления, на совершенствование механизмов межбюджетного регулирования. Выявляются правовые коллизии в системе распределения полномочий. Обосновываются конкретные предложения по модернизации конституционно-правовых институтов федерализма. Тенденции централизации власти актуализируют вопрос о сохранении федеративных принципов. Расширение перечня вопросов совместного ведения, усиление контроля за региональным законодательством, изменение порядка формирования органов власти субъектов Федерации — все эти процессы нуждаются в комплексном изучении. Оценка эффективности действующей модели разграничения предметов ведения определяет научную и практическую значимость настоящего исследования.

Optimization of the Constitutional and Legal Mechanisms of Federalism

The article is devoted to the current problems of optimizing the constitutional and legal mechanisms of Russian federalism. The relevance of the research is due to the change in the Basic Law, which affected the fundamental principles of the organization of public power, raising the question of reviewing approaches to the regulation of federal relations. Issues related to the modern practice of implementing federal principles, which show noticeable discrepancies with constitutional provisions, are becoming particularly acute. The problems of separation of powers, the imbalance of inter—budgetary relations, the lack of consideration of regional specifics - all this is due to the relevance of the research topic. Consideration of the positions of leading legal scholars and economists such as I.V. Danilov, E.V. Belousova, S.S. Zenin, I.V. Ivanov, A.A. Ostovskaya, I.N. Kuznetsov, E.G. Tronina, T.A. Panarin and others allows us to draw up a comprehensive picture of the challenges and opportunities for optimizing this issue. The expediency of developing the topic is due to the particular severity of systemic contradictions in the division of subjects of jurisdiction between the federal center and the subjects of the Federation, i.e. the impact of the constitutional reform of 2020 on the balance in federal relations. Attention is drawn to the problems of implementing the principles of unity and subsidiarity in the context of centralized management, attention is also paid to improving the mechanisms of inter-budgetary regulation. Legal conflicts in the system of distribution of powers are revealed. Specific proposals for the modernization of the constitutional and legal institutions of federalism are substantiated. The trends of centralization of power actualize the issue of preserving federal principles. Expanding the list of issues of joint management, strengthening control over regional legislation, and changing the formation of government bodies in the constituent entities of the Federation - these processes need to be comprehensively studied. Evaluation of the effectiveness of the current model of differentiation of subjects determines the scientific and practical significance of this study.
