В статье исследуется понятие законного интереса в гражданском праве в контексте принципа необходимости беспрепятственного осуществления гражданских прав. Авторы раскрывают многоуровневое значение данной категории: она выступает критерием допустимого ограничения частной автономии, самостоятельным объектом судебной защиты, ориентиром добросовестного поведения и конструктивным элементом отдельных гражданско-правовых институтов. Особое внимание уделяется доктринальному анализу соотношения законного интереса и субъективного права. Обосновывается, что законный интерес нетождествен субъективному праву, поскольку является менее формализованным, но при условии правомерности, индивидуализации и добросовестности он подлежит правовой охране.
На основе анализа норм Конституции РФ, Гражданского кодекса РФ, научной доктрины и судебной практики Верховного Суда РФ и Конституционного Суда РФ формулируются критерии признания интереса законным и условия допустимого вмешательства в него. Делается вывод о необходимости законодательного закрепления общей нормы о законном интересе и унификации терминологии, используемой в гражданском законодательстве.

The Concept of «Legal Interests» in the Context of the Principle of the Necessity of the Implementation of Civil Rights Without Obstacles: Theoretical Issues

The article explores the concept of legitimate interest in civil law in the context of the principle of the need for unhindered exercise of civil rights. The author reveals the multi-level significance of this category: it serves as a criterion for permissible restrictions on private autonomy, an independent object of judicial protection, a guideline for good-faith behavior, and a constructive element of certain civil law institutions. Special attention is given to the doctrinal analysis of the relationship between legitimate interest and subjective rights. It is substantiated that a legitimate interest is not identical to a subjective right, as it is less formalized, but it is subject to legal protection if it is legitimate, individualized, and conducted in good faith. Based on an analysis of the norms of the Constitution of the Russian Federation, the Civil Code of the Russian Federation, scientific doctrine, and judicial practice of the Supreme Court of the Russian Federation and the Constitutional Court of the Russian Federation, the criteria for recognizing an interest as legitimate and the conditions for permissible interference in it are formulated. It is concluded that it is necessary to legislate a general rule on legitimate interests and to unify the terminology used in civil legislation.
